Federal prison sentence handed down in arson case

A 55-year-old man was sentenced to 20 years in federal prison on charges of arson and making false statements. He submitted a falsified tax return to a bank in an effort to get a construction loan. The man had owned several properties in North Carolina, but he was in financial trouble at the time of the loan application. The arson charge was related to the intentional burning of a rental home that the defendant owned.

Authorities found his DNA on a glove near the scene of the fire. Camera footage also captured his SUV near the home just before the incident happened. Another person allegedly acted as an accomplice during the arson, and that person was eventually acquitted of arson, wire fraud and other charges. At his July 2018 trial, the man who owned the burned-down rental home was convicted of making the false statements.

The jury was hung on all other charges, but the defendant entered a guilty plea to the arson charge before the second trial could begin. However, during sentencing, he claimed that he had not actually committed the arson. Although he tried to use his military service to obtain leniency, the judge in the case was not moved. The judge cited his lack of contrition and the fact that he perjured himself during his trial.

Those who are convicted of federal charges may face penalties including prison time, probation and restitution. Sentences may also include fines or other consequences as allowed by law. Hiring an attorney may make it easier for an individual to create a defense to those charges. Defenses may include casting doubt on witness testimony or the accuracy of camera footage. It may also be possible to point to a person's mental state when a potentially criminal act occurred.
