Man sentenced in Medicaid fraud case

On May 25, a man was sentenced to a year of house arrest and five years of probation for participating in a Medicaid fraud scheme. He must also pay $393,000 in restitution to the North Carolina Medicaid program.

Between October 2011 and December 2013, the defendant recruited clients for a behavioral health counseling business operated by a former North Carolina State University football player and his wife. In return, he was paid nearly $400,000 in kickbacks. According to federal investigators, the funds came from Medicaid fraud.

In March, the former football player pleaded guilty to federal bribery and money laundering charges in connection with the scheme. He has not yet been sentenced, but he has already agreed to pay $420,000 as part of the plea deal. Investigators say that his counseling business illegally billed Medicaid for services it did not provide. Between 2012 and 2014, it billed the government health insurance program for $8.7 million, which is more than any other similar counseling agency in the state. The money reportedly paid for renovations for his $1.5 million house and the down payment for a luxury sports car. In 2011, North Carolina State University banned him from campus after he was accused of providing impermissible benefits to student-athletes.

Federal criminal cases can lead to severe consequences. Individuals facing federal charges may want to contact a federal criminal defense attorney to help protect their rights throughout court proceedings and explain all legal options available. Depending on the evidence in the case, legal counsel may advise negotiating a plea deal with prosecutors. This strategy would allow a defendant to bypass a trial and might reduce his or her sentence.
