Two men taken into custody on drug charges

Two men who were taken into custody in North Carolina on June 13 allegedly had almost a pound of cocaine in their possession. The men were detained around 2:30 in the afternoon. The 37-year-old man is a resident of North Carolina, and although the 26-year-old man gave a California address, he is actually from Canada according to federal immigration officials.

3 North Carolina men face federal prison for trafficking drugs

According to news sources, three men from Sampson, North Carolina, are facing federal prison for allegedly running a sophisticated drug trafficking organization. The trio was convicted of the charges against them after a seven-day jury trial in the U.S. District Court for the Eastern District of North Carolina.

Understanding federal carjacking charges and penalties

It is not uncommon for motor vehicles to be stolen in North Carolina. There is a difference, however, between certain types of car theft. Carjacking is an allegation that can result in major penalties if there is a conviction. The circumstances will determine the level of charges. On May 23, it was reported that a North Carolina man was indicted on child pornography charges by a federal grand jury. According to the indictment, the 22-year-old Wilmington man was accused of receiving and possessing multiple files that contained sexual images with minors in them.

Former North Carolina deputy indicted on drug and gun charges

A 33-year-old former deputy at the Gates County Sheriff's Office has been indicted by a federal grand jury for allegedly stealing guns and drugs. The federal charges against him involve illegally possessing two firearms and possessing various controlled substances for the purposes of distribution.

Newly elected mayor gets drunk driving charge

A man who won an election to become the mayor of Sharpsburg, North Carolina, was taken into custody for DUI hours after winning. The man arrived in Nash County Jail at about 11:30 p.m. on May 8 and was released the next morning. He was charged with driving while impaired as well as being in possession of a concealed weapon and possessing it while consuming alcohol.

DWI charges for county employee

A North Carolina man who worked as a quality assurance specialist for a county emergency medical service was dismissed from his job after being charged with DWI. The charge is in relation to an incident that happened on the morning of April 21.

General Assembly Approves Revisions to Workers Compensation Penalty Statute

For years Dysart Willis has been at the forefront in representing North Carolina businesses who have received a Penalty Assessment Order from the Industrial Commission for failure to carry workers' compensation insurance.  Generally, NCGS § 97-93 requires that any employer with three of more employees have workers' comp coverage and NCGS § 97-94 allows for a $50 to $100 per day penalty if an employer fails to have such insurance. Additionally, the statute permits potential criminal charges and contempt proceedings. A focused effort by the Industrial Commission to enforce compliance has been in effect since roughly 2013. As discussed on this blog before, beginning in early 2017 the Industrial Commission adopted a punitive approach to these cases which has unnecessarily and unfairly threatened small businesses and business owners.
